General Terms and Conditions Orbit Wheels FZ LLC | Ras Al Khaimah, UAE
These General Terms and Conditions govern all vehicle lease-to-own agreements provided by Orbit Wheels FZ LLC ("Lessor") to customers ("Lessee"). By entering an agreement, the Lessee agrees to these terms, compliant with UAE laws, including Federal Law No. 5 of 1985 (UAE Civil Code), Federal Law No. 8 of 2018 (Financial Leasing Law), and Federal Law No. 15 of 2020 (Consumer Protection).
- Agreement and Term The lease begins on the agreed date and runs monthly, with automatic renewal unless terminated with 7 days' written notice. The vehicle remains the Lessor's property until all payments are completed.
- Payments Monthly rental fees are non-refundable, payable via approved methods. Early termination incurs penalties: 2 months' fees in the first year, 1 month's fee after 2 years. Non-payment allows vehicle repossession, with the Lessee liable for costs.
- Ownership and Buyback Ownership transfers only after full payment and compliance with terms. A buyback option at zero cost is available upon lease completion, subject to vehicle condition.
- Insurance and Usage The Lessor provides comprehensive insurance; the Lessee is liable for negligence-related costs. Usage is restricted to personal/light commercial purposes, with no illegal activities or modifications without approval. Mileage limits apply; excess incurs additional charges.
- Maintenance and Liabilities The Lessee must ensure the vehicle is available for regular servicing. The Lessee is responsible for traffic fines, accident costs (if at fault), and personal belongings.
- Legal and Dispute Resolution Governed by UAE laws, with disputes under Ras Al Khaimah court jurisdiction or arbitration. Disputes are first addressed through negotiation, then arbitration if unresolved.
- Miscellaneous Personal data is protected per UAE law; GPS tracking is used for security. Communications may be sent via email, SMS, or WhatsApp. Terms may be amended with mutual consent and notice.
